Rules
RULES, TERMS OF USE, MODERATION POLICY AND WARNING SYSTEM
You agree, through your use of this service, that you will not use this bulletin board to post any material which is:-
· in contravention of any relevant local, national or international law or which incites or encourages the contravention of any such law;
· knowingly inaccurate, false and/or defamatory;
· racist, sexist or homophobic;
· pornographic, obscene, profane or vulgar;
· defamatory of any person, entity or organisation;
· abusive, threatening, hateful, harassing or otherwise likely to be harmful to those persons likely to use the Site;
· otherwise offensive or unsuitable in the opinion of UK Fiesta Network Limited;
· infringing of the rights (including the intellectual property rights) of any person or invasive of a person's privacy;
· related to the conduct of a business, including the offering of products or services without Authorised Trader status;
· considered to be “spam” (meaning, but not being restricted to, an inappropriate, unhelpful, flippant or unnecessary submission in the opinion of UK Fiesta Network Limited);
· intended to incite a “flame” war with other members or members of any other online community forum;
· repetitive of a message that has been removed from the board by a moderator or club staff member;
· any other form of unauthorised advertising.
By submitting information to the forums, you grant UK Fiesta Network Limited a non-exclusive worldwide royalty-free perpetual non-revocable licence to use, distribute, adapt, modify, display, reproduce and transmit such information in any and all media in any manner in whole or in part without any duty to account to you. You also grant UK Fiesta Network Limited the right to grant licences to users of the Site to view and copy such information for personal use.
UK Fiesta Network Limited, through it's team of Moderators and through it's "TeamUKFN" staff members, reserves the right to edit or delete any messages left on the forums, including without limitation any message which contravenes the rules above or which is deemed otherwise unsuitable to remain in the public areas of the forums. Any user who feels that a posted message is objectionable or is in contravention of the above rules is encouraged to let us know either by using the "Report This Post" button (visible next to each and every post on our forums) or by email to admin@ukfiestanetwork.co.uk. We have the ability to remove objectionable messages and we will make every effort to do so, within a reasonable time frame, if we determine that removal is necessary.
We operate a warning system on this board which, in the interests of transparency, is visible to each user. You will see the warning level meter displayed every time you submit a post to the board. It is shown as a graphic below your avatar and member group display. No members, other than UKFN staff members, can see the warning level meter of any other member. The warning level meter comprises five levels, rising from level 0 to level 5. Every time that a member of the moderating team is forced to delete or substantially edit a post for contravention of the terms and conditions of use of these forums, they will coincidentally increase that member’s warning level. If, for example, a moderator removes a post that you have submitted to the board because it is considered offensive and should not have been posted as it is in breach of our Terms & Conditions of use, that moderator will advance your warning level by 1 point. This increase would be displayed on your warning level meter. If this was the first time that this had occurred, your warning level meter would display “level 1”. For a second offence, it would display “level 2” and so on.
If a member’s warning level meter reaches level 5 (that is to say a member already on a level 4 warning is reprimanded for an improper submission to the board), that member will be automatically suspended from using the forums for a period of 30 days. This is an automatic suspension. The moderating team have no discretion in reducing or ignoring such a suspension. After a period of 30 days a suspended account will become active again and the warning level meter will be returned to 0. If the warning level meter of any member who has been previously suspended reaches level 5, there is no second suspension. Instead, that account will be permanently barred and will not be reactivated.
In the event that such a member is a Plus+ member of the forum and a full member of the club, their membership will be cancelled and any subscription paid will be forfeit, without refund. If such a member has obtained an ongoing member benefit - for example, discounted insurance due to UKFN Plus+ membership - then the provider of that service will be alerted to the termination of membership. In the instance of the provision of discounted motor insurance, this is likely to invalidate your policy.
Any member who creates an alternative user account to access the forums whilst suspended will have any such account blocked, their usual account will be permanently barred and they will not be able to continue to access the forum or participate in club activities. Any member who comments that they are aware that someone has registered an alternative account will be assumed to approve of breaches of the forum rules and will have their own warning level indicator increased.
We will take any action that we consider appropriate against banned members who persist in trying to access the forums. We consider such attempts to access the forums as nuisance. In the past, we have alerted ISPs to such attempts, submitting IP logs and evidence of inappropriate posts that caused such members to be banned. These ISPs included, in two instances, an employer and a university. In the first instance, we insisted that the employer took disciplinary action against the employee. In the second, we insisted that the university concerned took action under its published internet policy. The student concerned had this action added to their permanent university record. “Nuisance” users spoil the enjoyment of the forums for other members and will not be tolerated.
